Terms of Use

These terms govern your use of the CloudGuard platform and website at cloudguard.solutions. By creating an account or using the service, you agree to them.

The service

CloudGuard is a security posture and compliance platform that scans cloud accounts, virtualization environments, and servers that you connect, identifies configuration issues, and produces compliance reporting. CloudGuard performs configuration posture assessment; it is not a guarantee that your environments are free of vulnerabilities, that any particular compliance outcome will be achieved, or that any given compliance framework's requirements are fully satisfied. CloudGuard is a tool that supports your security and compliance program; it does not replace your organization's own judgment, controls, or obligations.

Your account and acceptable use

Plans, billing, and trials

Paid plans are billed monthly through our payment processor. Trials convert to paid plans unless cancelled before the trial ends. You can cancel at any time; cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law. Enterprise plans may be subject to a separate order form or agreement, which will govern in the event of any conflict with these terms.

Your data

You retain all rights to your data. You grant us the limited rights needed to operate the service: to scan the environments you connect, store the resulting findings, and generate reports for you. We do not use your data to train any model or product feature outside your own account, and we do not sell your data. Our handling of personal information is described in the Privacy Policy.

Intellectual property

CloudGuard and its underlying software, design, and content are owned by us and protected by intellectual property law. These terms grant you a limited, non-exclusive, non-transferable right to use the service for your internal business purposes. Nothing in these terms transfers ownership of the platform, its source code, or its branding to you.

Confidentiality

Each party may have access to confidential or proprietary information of the other in connection with the service. Each party agrees to use the other's confidential information only as needed to perform under these terms, and to protect it with the same degree of care it uses for its own confidential information, and no less than reasonable care.

Availability and support

CloudGuard's scanning infrastructure runs on continuously monitored cloud systems, with maintenance and updates released on a rolling basis to keep scans, findings, and reports accurate and current.

Every account includes direct access to the CloudGuard team through the in-product support desk, where queries are handled by the engineers who build the platform, not a third-party call center. Support is also reachable at support@cloudguard.solutions, with responses generally provided within one business day. Enterprise plans include a dedicated account manager and any additional service levels agreed in a separate order form.

Except where a specific service level is set out in an executed order form, the service is provided on an as-is and as-available basis, without warranties of any kind, express or implied.

Limitation of liability

To the maximum extent permitted by law, CloudGuard's total liability arising out of or related to the service is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect, incidental, special, or consequential damages, or for security incidents in your environments; the service assists your security program but does not replace it, and you remain responsible for your own environments and security decisions.

Termination

You may stop using the service and close your account at any time. We may suspend or terminate accounts that violate these terms, pose a security risk to the platform or other customers, or where required by law. On termination, your data is retained and deleted as described in the Privacy Policy.

Export compliance

You may not use or export the service in violation of applicable export control or sanctions laws, and you represent that you are not located in, or a resident of, any country subject to a comprehensive embargo, and are not on any restricted party list.

Governing law

These terms are governed by the laws applicable in our jurisdiction of operation, without regard to conflict of law principles. Any dispute arising from these terms will be resolved in the courts of that jurisdiction, unless otherwise required by applicable law.

Force majeure

Neither party is liable for delay or failure to perform obligations under these terms resulting from causes beyond its reasonable control, including acts of God, natural disaster, war, terrorism, labor disputes, internet or utility failures, or governmental action.

Changes

We may update these terms; material changes will be notified to account owners by email. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
